Could I sue my roommate if he is claiming that I rent from him even though both our names are on the lease?
By Planet Wealth
I got a place with a girl and her boyfriend a month ago. I paid my share of the first months rent directly to the landlord. At the end of the month the day before rent is due, I got into a car accident which left me not able to go for the next few days. When I came to, I contact the landlord and we made an agreement that I would pay my share a week late because of the accident. I contacted my roommates to let them know but started arguing with me about the rent being late even though I had let the landlord know the situation. The boyfriend then started claiming that I am renting from him and that I owe him money. I have my share for the rent but I want to pay directly yo the landlord. I have never signed anything that said he’s subleasing to me.
Btw I talked to the landlord about removing my name from the lease so would I sti have to pay rent for the next month even though I won’t be living there anymore?

Exactly what grounds would you sue him for? That he is annoying?

If your name is on the lease, you owe the rent. If your name isn’t, and you have no written agreement to pay rent to your roommate, then you have no obligation to pay rent. In some places, if you made an oral agreement and there are sufficient witnesses that agree, a judge will uphold that you entered into a verbal contract, but most often, if it’s not in writing, it didn’t happen.

You can’t sue your roommate, but you will need the approval of your roommate and the landlord to get your name removed from the lease (all parties must agree). When a name is removed from a lease, the lease is voided and a new lease is written and signed for the future.
I wonder if your roommates claim that you owe him was because he covered your share and simply wants to be reimbursed.
